Terms of Service

These Terms of Service ("Terms") govern your engagement with Tech Bytes Design ("we", "us", "our", "the Company") — including use of our website, client portal, and all web development services. By accessing our website, creating an account, or requesting our services, you agree to be bound by these Terms.
1. Services
Tech Bytes Design provides custom web development services including website design and development, web application development, UI/UX implementation, performance optimisation, and deployment assistance. Every deliverable is built from scratch according to agreed project requirements.
2. Client Portal & User Accounts
2.1 Account Registration. You may create a client account on our portal using your email address and password, or by signing in with Google. You must provide accurate and complete information during registration.
2.2 Account Eligibility. You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement.
2.3 Account Security. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
2.4 Account Termination. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent activity.
2.5 Google Sign-In. If you register using Google, we receive your name and email address from Google as authorised by you. Your use of Google Sign-In is also governed by Google's Terms of Service.
3. Project Engagement
3.1 Scope Agreement. A project formally begins only after both parties have agreed — in writing (email or messaging platform) — on the project scope, timeline, and pricing.
3.2 Client Responsibilities. You are responsible for supplying accurate and complete project requirements, brand assets (logos, images, content), and timely feedback. Delays caused by incomplete information or delayed approvals may impact the agreed delivery timeline, without any liability to Tech Bytes Design.
3.3 Revisions. Each project includes a reasonable number of revision rounds as discussed during the kickoff phase. Material changes to scope after development has commenced may require a revised quote and timeline.
3.4 Timeline. Delivery timelines are estimates provided in good faith. Tech Bytes Design will communicate proactively if delays arise and is not liable for indirect or consequential losses resulting from delays outside its reasonable control.
4. Project Cancellation
4.1 Cancellation Requests. If you have an active project and wish to cancel, you may submit a cancellation request through your dashboard. All cancellation requests are reviewed by our team and are not automatically approved.
4.2 Policy Application. All cancellations are subject to our Refund Policy (see separate document). Eligibility for a refund depends on the stage of work completed at the time of the request.
4.3 No Cancellation After Delivery. Once any deliverable has been provided or the project has been deployed to a live environment, cancellation requests will not be considered.
4.4 Response Time. We will review and respond to all cancellation requests within 1–2 business days.
5. Payment
5.1 Pricing. All pricing is quoted and agreed in writing before project commencement. Prices are in Indian Rupees (INR) unless otherwise stated.
5.2 Payment Schedule. Payment milestones are agreed per project (for example: 50% advance, 50% on delivery). Specific terms are communicated in your project proposal.
5.3 Withholding Delivery. Final deliverables, source code, and deployment assistance will not be released until full payment has been received.
5.4 Taxes. Quoted prices are exclusive of applicable taxes (e.g., GST) unless explicitly stated otherwise.
6. Intellectual Property
6.1 Post-Payment Transfer. Upon receipt of full and final payment, all intellectual property rights to the delivered work — including code and visual design — transfer to you, the client.
6.2 Pre-Payment Ownership. Until full payment is received, all work in progress and deliverables remain the exclusive intellectual property of Tech Bytes Design.
6.3 Portfolio Rights. We reserve the right to showcase completed, publicly deployed work in our portfolio, website, and marketing materials. If you require confidentiality, notify us in writing before project commencement.
6.4 Third-Party Assets. Open-source libraries, fonts, stock images, or other third-party assets used in your project remain subject to their respective licences. We will notify you of any such assets used.
7. Confidentiality
Both parties agree to keep confidential any non-public business information, technical details, or materials shared during the course of the project. This obligation survives termination of the engagement.
8. Warranties and Liability
8.1 We warrant that all original work produced is our own and does not knowingly infringe third-party intellectual property rights.
8.2 Software is delivered following reasonable testing. We do not warrant that delivered software will be entirely free of defects or will operate without interruption in all environments.
8.3 Our total liability arising out of or in connection with any project is limited to the total fees paid by you for that specific project.
8.4 We are not liable for any indirect, consequential, incidental, or special damages, including but not limited to loss of revenue, data, or business opportunities.
9. Termination
Either party may terminate the engagement with written notice. If terminated mid-project, you are liable for payment proportional to the work completed to date. Advance payments for unstarted work may be refunded at our discretion, subject to the Refund Policy.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Srinagar, Jammu & Kashmir, India.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our website or services after an update constitutes your acceptance of the revised Terms. We will update the effective date at the top of this page whenever changes are made.
